FMCSA Suspends HOS Regulations for Some Drivers & Carriers

Pursuant to the emergency declared by the President, the Federal Motor Carrier Safety Administration has issued its own emergency declaration granting temporary emergency waivers from hours-of-service (HOS) regulations in certain situations.

In particular, motor carriers and drivers providing direct assistance in support of coronavirus relief efforts have been granted emergency relief from the regulations. Some restrictions do apply, however. In order to meet the qualifications for the waiver, shipments must be 100% comprised of certain types of good specified in the emergency declaration; shipments mixed with other types of goods will not qualify, and thus will still need to be in compliance with normal HOS requirements. Drivers of CMVs used in the interstate transport of cargo as a part of regular commerce are also still bound by all applicable regulations.
